How software programs work
It is extremely important that parties in
liability cases (criminal and civil) understand the computer program(s) that
created the issue in question.
Computer software programs can work in strange
ways, and not understanding how they work can lead to misunderstandings,
particularly when it comes to civil and criminal cases.
For instance, in one case, both parties did not
understand that winzip, a file compression and viewing utility, created a
separate file folder on a different drive that remained on the drive.
Although this explanation is somewhat simplified, while one party believed
the other intentionally saved data when it should have been destroyed, and
the other party thought they destroyed the data, once it was discovered how
the data had mysteriously been saved to another drive, both parties
conflicts were resolved.
